WEBSITE PRIVACY POLICY
GENERAL INFORMATION
The Lithuanian Council for Culture respects your right to privacy and the protection of personal data. This Privacy Policy (hereinafter referred to as the Privacy Policy) establishes the conditions for the processing of personal data by persons using the website www.ltkt.lt (hereinafter referred to as the website) operated by the Lithuanian Council for Culture, as well as for the processing of personal data carried out on this website. The terms and conditions set out in this Privacy Policy shall apply to every access to the published content and/or service, irrespective of the device used (computer, mobile telephone, tablet, TV, etc.).
The Lithuanian Council for Culture aims to ensure transparency and fairness in the processing of personal data. It is very important that you read the Privacy Policy carefully and understand how and why personal data is processed.
The controller of the personal data shall be the state-funded institution Lithuanian Council for Culture, legal entity code 302951857, operating at Naugarduko st. 10, Vilnius, e-mail info@ltkt.lt.
We hereby confirm that personal data are processed in accordance with the applicable requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as Regulation (EU) 2016/679), Republic of Lithuania Law on Legal Protection of Personal Data, the Republic of Lithuania Law on Electronic Communications, and the requirements of other legal acts, and the instructions of the controlling bodies.
When processing personal data, we shall implement appropriate organisational and technical security measures to protect personal data against accidental or unlawful disclosure, alteration, destruction or other unlawful processing.
The terms used in the Privacy Policy shall be as defined in the Regulation (EU) 2016/679.
FOR WHAT PURPOSES, WHAT PERSONAL DATA AND ON WHAT LEGAL BASIS WE PROCESS
The Lithuanian Council for Culture (hereinafter referred to as the Council) shall process personal data on or through the website for the following purposes.
In order to enable you to submit your institution for funding to the Council cultural and artistic project, and to monitor the progress of the examination and execution of this project, you may access the Council's website via the Lithuanian Council for Culture's Electronic Culture and Arts Project Management System. In this case,for the purpose of administeringcultural and artistic projects, the Council shall process your personal data, i.e. name, surname, identification data obtained from the Electronic Government Gateway portal, the name of the institution represented, the position held, the application and submission data, the login data (date, time, IP address), the data included in the application, and any other necessary data. The processing of personal data shall be carried out in the performance of statutory duties and the exercise of the functions conferred on the Council in accordance with Article 6(1)(c), (e) of Regulation (EU) 2016/679.
In order for the Council to provide you with information about events, conferences and Council activities, it shall be made possible to subscribe to its newsletter. In this case, for the purpose of sending the newsletters and administering their subscription, your personal data such as your e-mail address, subscription order and confirmation data (date, time, IP address) shall be processed. Personal data shall be processed with the consent of newsletter subscribers in accordance with Article 6(1)(a) of Regulation (EU) 2016/679.
In order to enable the Council to inform the public about its activities, the website shall publish personal data of Council officials and employees, i.e. name, surname, position, functions performed, special requirements for the position, contact details, image, data of persons participating/previously involved in projects, events and activities organised by the Council, i.e. name, surname, position, information on participation in projects, events and activities organised by the Council, other necessary data. The processing of personal data shall be carried out in the performance of statutory duties, in the exercise of the functions conferred on the Council and with the consent of the individual, in accordance with Article 6(1)(a), (c), (e) of Regulation (EU) 2016/679.
In order to enable the Council to provide you with access to the website and information society services, and to improve the functioning of the website and the use of services, the Council shall process personal data of visitors to the website, which it receives via cookies. For detailed information on the use of cookies, please refer to the section “Why do we use cookies and what cookies do we use?”. Personal data collected by means of cookies shall be processed on the basis of consent and legitimate interest to ensure the proper functioning of the website and the provision of services, in accordance with the Republic of Lithuania Law on Electronic Communications, Article 6(1)(a), (f) of Regulation (EU) 2016/679.
The Council may also process personal data for other purposes to the extent necessary for the legitimate exercise of its activities, to comply with legal requirements, to defend itself against claims and lawsuits, and to protect the legitimate interests of the Council.
ORIGIN OF THE PERSONAL DATA PROCESSED
The Council shall process the personal data that you yourself, i.e. the data subjects (the persons whose data are processed), provide to it directly or that the Council receives from third parties entitled to provide personal data to the Council (e.g. in the case where you verify your identity by using the services of the Electronic Government Gateway portal, the Council shall receive your personal data from the operator of this portal, the Information Society Development Committee).
WHO DO WE DISCLOSE YOUR INFORMATION TO?
Personal data published on the website shall be publicly available to visitors to the website.
Personal data may be disclosed to public institutions and bodies, other third parties if the Council is obliged to do so by law or regulation or if there is a need to protect the Council's interests. In addition, personal data may be provided to other persons who have a right to receive personal data processed by the Council.
Personal data shall be provided to the Council's data processors, which are selected service providers (providers of information systems maintenance, website development, maintenance and hosting, data storage and other services). These service providers shall process personal data on behalf of the Council and only on the Council's instructions.
HOW LONG DO WE RETAIN PERSONAL DATA?
The Council shall retain personal data only to the extent necessary for the stated purposes of processing personal data or to the extent required by law.
For the purpose of administeringcultural and artistic projects, the Council shall retain personal data for 3 years if no funding is granted, for the duration of the project if funding is granted, and for 10 years afterwards.
For the purpose of awarding grants and other financial support to cultural and artistic creators, the data shall be retained for 3 years if funding is not granted, and 10 years if funding is granted.
For the purpose of sending newsletters and administering subscriptions, data shall be retained for 5 years.
For the purpose of informing the public, data shall be retained within the terms laid down by law and/or for as long as it satisfies the public's need to know such information, by reviewing the necessity of retaining personal data every 10 years.
For the purposes of ensuring the functionality and efficiency of the website, user-friendliness, website speed and security, personal data shall be processed for the duration of the cookie.
After the expiry of the retention periods referred to above, the personal data shall be destroyed beyond recovery or transferred to a public archive, if the Council is required to do so by law.
WHAT RIGHTS YOU HAVE AND HOW YOU CAN EXERCISE THEM?
Regulation (EU) 2016/679 gives data subjects a number of rights. As a data subject, you shall have the following rights:
- To know about the processing of your personal data;
- To have access to and receive a copy of your personal data;
- To request the rectification of inaccurate or incomplete personal data;
- To require restriction of the processing of personal data;
- To request the erasure of personal data;
- To withdraw your consent to the processing of personal data;
- To object to the processing of personal data;
- The right to portability of personal data;
- To complain about the Council's actions or omissions to the supervisory authority, the State Data Protection Inspectorate.
The rights of data subjects shall be exercised in accordance with the conditions and to the extent set out in Regulation (EU) 2016/679.
In order to exercise the above-mentioned rights with respect to the processing of personal data described in this Privacy Policy, you must contact the Council at the contact details indicated in the Privacy Policy by submitting a written request in the recommended form approved by the Council, or a free-form request, and by providing proof of your identity.
The request must specify which of the above-mentioned rights you wish to exercise and to what extent.
You may verify your identity in the following ways:
- By applying in person, together with proof of identity;
- By post, together with a copy of the proof of identity certified by a notary public, or a copy of this document certified by another legal procedure;
- By electronic means, signed by a qualified electronic signature or made by electronic means capable of ensuring the integrity and integrity of the text, or by any other means allowing the identity of the data subject to be verified.
The requirement to confirm the identity of the person shall not apply if you request information on the processing of personal data in accordance with Articles 13 and 14 of Regulation (EU) 2016/679.
If the Council has doubts about your identity as a data subject, or if the information provided in the request does not allow the Council to establish your identity, the Council may request additional information necessary to unambiguously confirm your identity.
The Council shall provide you with information on the action it has taken in response to your request no later than one month from the date of receipt of your request. In the case of complex or multiple requests, this term may be extended by a further two months if necessary, depending on the complexity and number of the requests. In any case, the Council shall inform you of such an extension within one month of the date of receipt of the request, stating the reasons for it.
If the Council decides not to comply with the request, it shall inform you immediately, but at the latest within one month from the date of receipt of the request, and you shall be able to appeal to the State Data Protection Inspectorate and to seek other legal remedies. In all cases, we would ask you to contact the Council before making a complaint, so that we may work together to find the best solution.
